A Feature of Primals Play
This Terms of Service for Primals Fantasy is governed by and incorporated into the Terms of Service.

1. Irrevocable Personal Service Retainer
Payment for a Primals Fantasy production constitutes a non-refundable retainer for professional labor and production resources. User acknowledges that Substantial Performance is achieved the moment the Host is booked and the production schedule is locked. Because the Host’s time and labor are finite resources that cannot be “un-spent,” the fee is fully earned at the point of scheduling. Cancellation by the User at any stage results in the immediate forfeiture of the retainer.
2. Creative Sovereignty & Subjective Satisfaction
Primals Fantasy is an artistic service. The Host maintains Absolute Creative Sovereignty over the execution of the requested concept. User contractually waives all rights to “creative satisfaction” or “quality disputes.” The service being purchased is the act of production, not a specific aesthetic outcome. Disagreement with the Host’s interpretation, performance, or creative choices does not constitute a failure of service and provides no grounds for refund or dispute.
3. Production Timeline & Rescheduling
All delivery timelines are estimates and do not form a “time is of the essence” clause. Host emergencies or technical delays may result in rescheduling. User agrees that production delays are not a breach of contract; the retainer remains active and valid for the eventual completion of the project. No refunds will be issued for “late” delivery.
4. Strict Usage Licensing
Delivery of a Primals Fantasy video grants the User a Private, Non-Exclusive, Single-User License for personal viewing only. Any commercial use, public display, or distribution is a material breach. User accepts Strict Liability for the security of the file; if the content is found on external platforms, the User is the primary debtor for damages.
5. Forensic Breach & $144,000 Liquidated Damages
Each custom video is embedded with unique, traceable forensic identifiers. User agrees that any leak of a Primals Fantasy production causes irreparable damage to the Host’s brand and exclusivity. User agrees to pay $144,000.00 USD as a genuine pre-estimate of liquidated damages per incident, regardless of how the leak occurred. User further agrees to cover all costs of forensic recovery and legal prosecution.
